The constraint driving the WNBA's current governance scramble is a policy gap.
The league has no eligibility rule that defines participation by genetic sex, and that absence became a public liability on Friday when former NBA players Enes Kanter Freedom and Royce White announced plans to declare for the 2027 WNBA Draft.
Commissioner Cathy Engelbert issued a memo to teams the same day, acknowledging the pressure and calling the topic "complex and nuanced." What Engelbert's memo actually says Engelbert told teams she knew many of them had been fielding questions about transgender athlete participation in women's basketball.
She thanked those who had "responded to questions from the media with thoughtfulness and professionalism," per the Associated Press. The memo did not announce a policy change or an enforcement mechanism.
