Halle Berry's attorney Marina Beck described Olivier Martinez's recent court filing as "entirely meritless and deliberately misleading" after the former partner sought sole custody of their son and obtained a temporary restraining order against Berry. The legal dispute centers on allegations of physical and emotional abuse against Maceo, the couple's 12-year-old son, which Martinez detailed in documents reviewed by People magazine and TMZ.
Martinez alleged that Berry physically abused Maceo by jumping on him, placing her hands around his neck, and choking him. He specifically cited an incident on September 26, 2026, claiming Berry entered their son's room while he wore virtual reality goggles, told him he looked "so stupid," and then attacked him. Martinez stated that Berry shouted, "Who is dominant now?!" during the encounter. He further claimed that Maceo contacted him after the incident to report the attack and noted that Berry's fiancé, Van Hunt, was present in the home at the time.
In her response to Fox News Digital, Beck argued that Martinez has a documented history of violating court orders and interfering with therapeutic and educational interventions for Maceo. Beck stated that Martinez has already been legally sanctioned for such misconduct and characterized his current filing as consistent with a pattern of erratic and possessive behavior. She added that Berry remains committed to fighting for Maceo's best interests despite the allegations.
A judge granted Martinez a temporary restraining order on Thursday, requiring Berry to maintain a distance of 100 yards from him. Under the current terms, Berry is limited to court-ordered visitations two days a week and every other weekend until a hearing scheduled for October 16. The petition also requests that Berry undergo sobriety testing before, during, and after any visits with their son. Both parties are ordered to attend confidential mediation regarding custody.
The legal conflict follows a divorce finalized in 2023, eight years after the couple initially split in 2015. Court documents indicate that Berry agreed to pay nearly $8,000 in monthly child support. Additionally, she is required to pay Martinez 4.3% of any income exceeding $2 million and covers 100% of Maceo's private school tuition, extracurricular activities, and health care costs. The divorce judgment also mandates that Martinez take reasonable action to find employment to contribute to their son's support.
This filing marks a significant escalation in a custody battle that began two years ago when Berry sought sole custody due to Martinez's alleged turbulent behavior toward educational interventions. The couple shares an 18-year-old daughter, Nahla Ariela Aubry, from Berry's previous relationship with Gabriel Aubry. Representatives for Martinez did not immediately respond to requests for comment from Fox News Digital.
